• PURPOSES

Your personal data will be used to: (i) document the hotel operations, as well as the hosting of retreats that you celebrate with Akalki, (ii) identify users, (iii) make available to you a means of disposition regarding the hosting operations, (iv) to request that you update your data, (v) prepare and register your room, (vi) monitor any request by phone call and follow up on customer complaints, (vii) support in the hiring of public transportation to airports, (viii) follow up on service payments, (ix) issue account statements, (x) record the operations you carry out, (xi) make quotes for long stays, (xii) contact you by phone, email and/or send you messages through your device for requests for information from users and/or clients, to give you notice of late payments or loans about to expire, confirmation of digital payments, confirmation of digital settlement of the loan, reminders to withdraw the good in deposit, confirmation of arrival, confirmation of flights, (xii) for geolocation of your transportation, (xiii) perform analysis of your dates to quote rates and budgets for withdrawals, (xiv) creation of profiles in the CRM for internal monitoring, (xv) preparation of quotes, management of SPA activities, (xvi) issuance of receipts, (xvii) sale of products and food, billing and collection, (xvii) wellness therapies and guidance services; (xviii) emotional wellness therapies; (xix) Tours in aquatic transportation systems; (xx) comply with tax obligations and those indicated by legislation.

For the purposes indicated in this Privacy Notice, we may collect your data:

• 2.By telephone.
• 3.Email.
• 4.Applications for mobile phones or computers.
• 5.And/Or through other optical, sound, visual, graphic means or by any legally permitted technology.

In the event that the owner of personal data considers that the processing of said personal data is not in accordance with the purposes described, he/she will have a period of five business days, if applicable, to express his/her refusal to the processing of his/her personal data, with respect to the purposes that are not necessary, nor gave rise to the legal relationship with the AKALKI HOLISTIC CENTER.

• MECHANISM FOR EXPRESSING REFUSAL FOR PROCESSING SECONDARY PURPOSES

If you do not wish for your personal data to be processed for the secondary purposes mentioned above, please mark the box with an “x”, in which case you may immediately submit a written request to gerenciar@akalki.com indicating the secondary purposes for which you do not wish to be processed. The refusal to use your personal data for these secondary purposes may not be the reason for us to deny you the services and products you request or contract with us.

It is important to note that CENTRO HOLÍSTICO AKALKI undertakes to process personal data solely and exclusively for the purposes approved by the owner, as well as to establish and maintain security controls for their protection.

Akalki informs you that the personal data of the OWNER will be processed by Akalki. Likewise, the data collected may be shared with federal and local authorities, in compliance with the obligations contemplated in the applicable legislation and in compliance with requests from them.

By making this Privacy Notice available to you, you have given your consent for the processing of your personal data. Furthermore, in accordance with article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, Akalki will transfer your data to comply with the legal relationship.

We inform you that for transfers indicated with an asterisk (*) we require your consent. If you do not express your refusal for such transfers, we will understand that you have given us your consent. If you do not accept the transfer of data, you must notify the email address of CENTRO HOLÍSTICO AKALKI: gerencia@akalki.com

Please be advised that Akalki has informed the third parties referred to above of their obligations regarding this Privacy Notice and its purposes, and therefore assume the obligations established herein when transferring your personal data.

ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION)

You, as the OWNER of your personal data, may exercise the rights of access, cancellation, rectification and opposition, with respect to your data (ARCO Rights). You have the right to know what personal data we will process, what we use it for and the conditions of use we give it (Access). Likewise, it is your right to request the correction of your personal information if it is outdated, inaccurate or incomplete (Rectification); that we delete it from our records or databases when you consider that it is not being used in accordance with the principles, duties and obligations provided for in the regulations (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). The request must be submitted by the OWNER or his legal representative to the email address referred to, said request must contain:

The full name of the OWNER and address or other means to communicate the response, including email address.

Documents proving your identity or that of your legal representative.

A clear and precise description of the personal data regarding which you will exercise your rights.

Any other element that facilitates the location of the personal data of the OWNER.

CENTRO HOLÍSTICO AKALKI will notify the OWNER within a maximum of 20 (twenty) calendar days, counted from having received the request for access, rectification, cancellation or opposition, the decision adopted, so that it becomes effective within the following 15 (fifteen) calendar days. These periods may be extended for an equal period when, at the discretion of CENTRO HOLÍSTICO AKALKI, the circumstances of the case justify it.

If further information is required, the controller will contact you. If there is no response from the OWNER, the request will be deemed not to have been submitted. The right of access applies when the OWNER wishes to know which of his/her personal data is held by CENTRO HOLÍSTICO AKALKI.

A request for access will be fulfilled by making available to the OWNER or his representative, after proving his identity, the documents containing the required personal data, either by means of photocopies, a CD containing said information, a USB device or any other means determined by CENTRO HOLÍSTICO AKALKI. The delivery of the data will be free of charge as long as the request for access is not repeated in a period of less than 12 months. The OWNER will only cover the costs of reproduction in copies or other formats and shipping.

The OWNER may rectify his/her personal data when these are inaccurate or incomplete, indicating in the rectification request the modifications that must be made and providing CENTRO HOLÍSTICO AKALKI with the documentation that supports his/her request. If the OWNER's request is admissible, CENTRO HOLÍSTICO AKALKI must inform the data processors and third parties of the changes in question, in the event that data transfers have been made under the terms of this Privacy Notice.

The right to cancellation consists of the elimination of personal data, followed by a blocking period that will be determined in accordance with the statute of limitations for actions arising from the applicable legal relationship. The cancellation of personal data will not be applicable in the cases provided for by law. CENTRO HOLÍSTICO AKALKI may retain the data exclusively for the purposes of liabilities arising from the processing of personal data. Once the data has been cancelled, its owner will be notified.

AKALKI HOLISTICAL CENTER may deny access to personal data, or carry out rectification or cancellation or grant opposition when the applicant is not the OWNER or the legal representative is not duly accredited to do so, or where appropriate when the personal data of the OWNER are not found in its database, the rights of a third party are violated, there is a legal impediment or resolution of a competent authority that restricts access to personal data or does not allow its rectification, cancellation or opposition and when the rectification, cancellation or opposition has been previously carried out.
